JUSTICE SANJAY PRIYA ORAL ORDER 01-05-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners seek bail in Doriganj P.S. Case No.164/16 registered for the offences under Sections 363,365, 369, 436/34 of the I.P.C.

As per allegation in the written report, on the date of occurrence the petitioners along with other co-accused persons came on the motorcycle and took away the wife of the informant, Tileshwari Devi. It is also alleged that co-accused, Krishna Rai, Sakaldip Rai, Harihar Rai, Manoj Rai, took away jewellery and burnt the house.

It has been mentioned in para 12 of the case diary that the place of occurrence is the part of the Goshala of the house

Patna High Court Cr.Misc. No.11498 of 2017 (3) dt.01-05-2017 2/2 of the informant. In paragraphs 42, 43, 46 of the case diary it has been mentioned that the victim lady was produced in the police station by her relatives, namely, Parmeshwar Rai and Lok Nath Rai but she did not depose before the police and she stated that she will depose before the court.

Considering the facts and circumstances of the case, the prayer for bail of the petitioners is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. VII, Chapra, in Doriganj P.S. Case No.164 of 2016 subject to the condition that both the bailers shall be close relatives of the petitioners.
