JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 12-08-2015 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the opposite party No. 2. The petitioner seeks anticipatory bail in connection with Katihar Mahila P.S. Case No. 33 of 2014 registered under Sections 341, 323,498-A read with 34 of the Indian Penal Code as well as 3 & 4 of the Dowry Prohibition Act. It is contended that there is no truth behind the allegation of subjecting the informant to cruelty for nonfulfilment of demand of dowry. The entire allegations made in the FIR are false and frivolous.

On the other hand, learned counsel for the informant has opposed the prayer for bail. He submits that the informant is

Be that as it may, regard being had to the nature of allegation, in the event of arrest or surrender within a period of four weeks from today, the petitioner is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Katihar in connection with Katihar Mahila P.S. Case No. 33 of 2014 subject to the conditions as laid down under Section 438(2) Cr. P.C.
