JUSTICE SANJAY PRIYA ORAL ORDER 10-05-2017 Heard learned counsel for the petitioners and the State. Petitioners seek bail in Pakribarawan P.S. Case No. 20 of 2017 instituted for the offence under Section-30(A) of the Bihar Prohibition and Excise At, 2016.

It is submitted that from the Scorpio car, total 1265 pouches of 200 ml each Masaledar country-made liquor were recovered. The petitioners along with one Chhotu Singh were found sitting in the aforesaid car. The aforesaid Chhotu Singh has been granted privilege of bail by a coordinate bench of this court by order dated 30-03-2017 passed in Cr. Misc. No. 13369 of 2017. It has been submitted that petitioners have no criminal antecedent.

No.18137 of 2017 (3) dt.10-05-2017 2/2 In such circumstances, the prayer for bail is allowed and the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Pakribarawan P.S. Case No. 20 of 2017 to the satisfaction of Sri Kumar Avinash, learned Judicial Magistrate-Ist Class, Nawada subject to condition that both the bailors should be close relatives of the petitioners with further condition that petitioners will file affidavit in the court below that they will not indulge in such type of activities in future and in the event, they indulge in the similar activity and similar case is filed against the petitioners, their bail bond is liable to be cancelled.
