The petitioner apprehends his arrest in Bhagwanpur P.S. case No. 176 of 2018 registered under Section 25(1-b) a, 26/35 of the Arms Act.

While the informant was checking the vehicles he saw three persons coming on a motor cycle but the miscreants after seeing the police party started fleeing away. On chase, two persons Vivek Kumar Singh and Vikesh Kumar Singh were apprehended. From the possession of Vivek Kumar Singh arms and ammunition were recovered. The apprehended accused disclosed the name of petitioner, who managed to flee away from the spot.

The learned counsel for the petitioner submits that nothing has been recovered from the possession of the

No arms was recovered from Vikesh Kumar Singh but it appears that all the three accused persons were coming on a motor cycle and from possession of Vivek Kuamr Singh arms and ammunition were recovered but the petitioner managed to flee away.

Considering the facts aforesaid and nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
