The petitioners have preferred this application for grant of regular bail in a case registered under sections 307, 379 and other sections of the Indian Penal Code.

As per the prosecution case, the petitioner no. 1 is stated to have threatened the informant over a dispute and thereafter it is stated that the seven other named accused persons including the petitioner no. 2 assaulted the informant and others. The petitioner no. 2 is stated to have assaulted the informant on his head with a garansa.

It is submitted by learned counsel for the petitioners that the two petitioners have been falsely implicated in the case.

So far as the allegation against petitioner no. 2 is concerned, the injury on the informant has been found to be simple in nature. The petitioners are in custody since 29.11.2020 and have no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the contents of the injury report of the informant together with the petitioners having remained in custody for more than 11 months, the Court directs both the petitioners to be enlarged on bail in connection with Sakri P.S. Case no. 107 of 2020 corresponding to C.R.I. no. 1376 of 2020 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani.
