====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bhaptiyahi P.S. Case No. 16 of 2017 instituted for the offence under Section-30(A) of the Bihar Prohibition and Excise Act, 2016.
As per written report, the police got information that four persons were digging sands with their hands. The raiding party surrounded them and recovered 156 bottles of 300 ml, each country made liquor and 60 bottles of Nepali liquor from beneath of the sand. The police apprehended those persons including this petitioner.
It has been submitted that one of the person who has been apprehended with this petitioner, has already been granted bail by a coordinate bench of this court vide order dated 04-04-
Patna High Court Cr.Misc. No.20823 of 2017 (2) dt.05-05-2017 2/2 2017 passed in Cr. Misc. No. 15891 of 2017.
In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bhaptiyahi P.S. Case No. 16 of 2017 to the satisfaction of learned Additional Sessions Judge-II (Spl. Judge, Excise Act), Supaul subject to condition that both the bailors should be close relatives of the petitioner.
