2. Learned counsel for the petitioners submits that petitioner no. 3, namely, Lalu Sahani has been arrested in this case. In that circumstance, learned counsel for the petitioners seeks permission to withdraw this bail application in respect of petitioner no. 3, namely, Lalu Sahani.
3. Permission is accorded.
4. This application is dismissed as withdrawn in
Patna High Court CR. MISC. No.14181 of 2025(2) dt.19-04-2025 2/3 respect petitioner no. 3.
5. The instant application for anticipatory bail has been filed by the petitioner nos. 1, 2, 4 and 5 apprehending their arrest in connection with Naurangiya P.S. Case No. 70 of 2024 instituted for the offence under Sections 191(2), 190, 127(1), 115(2), 118(1), 117(2), 109, 329(3), 329(4), 303(2), 352, 351(2) of the B.N.S.
6. The case of the prosecution is that the petitioners along with others being armed with weapon arrived at the door of the informant started abusing and it is alleged that Ravindra Sahani who was having farsa in his hand assaulted on the head of the informant due to which he received head injury. It is further alleged that Lalu Sahani assaulted with Tangi on the leg of the informant and Sharma Sahani attempted to strangulate Indu Devi with a gamcha due to which her bone of neck was fractured.
7. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in this case. It is further submitted by learned counsel for the petitioners that there is also a counter version of this case which is prior one. It has also been submitted that the victims of this
Patna High Court CR. MISC. No.14181 of 2025(2) dt.19-04-2025 3/3 case have received simple injury caused by hard and blunt substance. Only injury of Indu Devi is grievous which is on shoulder. A statement has been made in para-3 of this petiton that the petitioners have got no criminal antecedent.
8. In contra, learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioners.
9. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Naurangiya P.S. Case No. 70 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 2nd , Bagaha, West Champaran subject to the conditions as laid down under section 438(2) of the Cr.P.C.
