JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-03-2021 The present writ petition has been filed for considering the request transfer application of the petitioner, as contained in Annexure-3, which is dated 14.01.2019 and for quashing the order dated 07.01.2020 whereby and whereunder the petitioner has been transferred from Ramchandrapur Semaria to Patna.

The learned counsel for the petitioner has made a very short argument to the effect that as per the policy of the Bank, contained in Annexure-3/a to the present petition, which is dated 02.04.2016, the case of the employees of the respondent Bank pertaining to request transfer is required to be considered at least once during the entire career. The learned counsel for the respondents Bank has not been able to show from the record that the request made by the petitioner by his

Patna High Court CWJC No.4127 of 2020(6) dt.04-03-2021 2/2 application dated 14.01.2019 has been ever considered. This Court finds from the records that the petitioner is going to retire in the month of September 2021, hence, in case the request of the petitioner for transfer, according to his choice has not yet been considered, then the respondentauthorities are required to consider the same in accordance with law. In such view of the matter, this Court deems it fit and proper to direct the petitioner to approach the respondent no.1 by filing appropriate representation and in case such representation is filed within a period of two weeks from today, the respondent no. 1 shall pass appropriate order upon the same within a period of four weeks thereafter, taking into account the transfer policy of the respondent Bank, as contained in the letter dated 02.04.2016.
