Petitioner's mother died on the post of ANM while in harness on 18.06.2017. The entire death-cum-retiral dues of the late employee is prayed for in the present writ application. Counsel for the petitioner submits that the Civil Surgeon-Cum-Chief Medical Officer, Rohtas at Sasaram vide Memo No. 451 dated 19.02.2018 has already sent the required details to the Incharge Medical Officer, Primary Health Centre,
Patna High Court CWJC No.3732 of 2019(2) dt.05-03-2019 2/2 Karakat, Rohtas at Sasaram for payment of death-cum-retiral dues of the late employee and a communication has also been made by the Regional Additional Director, Health Services, Patna vide Memo No. 1096 dated 06.12.2018 which is Annexure-P-6 but till now payment of death-cum-retiral benefits and arrears of salary has not been given to the petitioner.
Considering the nature of claim made by the petitioner, this writ application is disposed of with a direction to the respondent no. 6, The Incharge Medical Officer, Primary Health Centre, Karakat, Rohtas at Sasaram to dispose of the representation as contained in Annexure-P-5 series dated 05.11.2018 and 01.12.2018 by speaking order within a period of two months from today. Any amount payable to the petitioner as per his entitlement, will be paid within one month thereafter. If certain amounts are inadmissible, the same shall be communicated by speaking order sent through registered post to the petitioner.
