Agrawal, learned senior counsel for the petitioner and the State through the virtual court proceeding. The petitioner apprehends his arrest in connection with Kahalgaon P.S. Case No. 181 of 2019 registered for the offences punishable under Sections 341, 323, 506, 379, 354/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is on police bail. Later on, the police has filed the charge sheet against the petitioner.
Learned counsel for the petitioner has relied upon a judgement in the case of Mahendra Prasad Singh vs. The State of Bihar reported in 2004(3) PLJR 491 in which the Court has held that the petitioner must honour the terms of
Patna High Court CR. MISC. No.9493 of 2020(4) dt.03-09-2020 2/2 police bail and appear before the Court without any delay. In case, petitioner appears before the Court below within six weeks then the Court below shall consider his prayer for bail in accordance with law keeping in view the well established principle that a person who is already on bail shall not be denied such privilege unless there is any allegations of misuse etc.
With this observation, this application for anticipatory bail is disposed of.
