====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-02-2025 Earlier, the pre-arrest bail application of the petitioner was heard and rejected by this court vide Cr. Misc. No. 38698 of 2019 dated 09.09.2019

2. Heard learned counsel for the petitioner and the State.

3. Petitioner apprehends arrest in a case registered for the offence punishable under Section 366A of the Indian Penal Code.

4. Prosecution case, in brief, is that this petitioner along with other F.I.R. named accused persons enticed away 14 years old daughter of the informant.

5. Learned counsel for the petitioner submits that during pendency of the case co-accused Jitendra Das has already solemnized marriage with the victim and they are living

Patna High Court CR. MISC. No.11098 of 2025(2) dt.20-02-2025 2/2 together as husband and wife. Petitioner is friend of co-accused Jitendra Das, who has already been granted anticipatory bail by this Hon'ble Court vide order dated 10.04.2024 passed in Cr. Misc. No. 12536 of 2024. Petitioner claims clean antecedent.

6. Learned A.P.P. for the State vehemently opposed the bail application.

7. Considering the aforesaid contention made on behalf of the petitioner, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Narpatganj P. S. Case No. 39 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
