The petitioner seeks regular bail in connection with Bochaha P.S. Case No. 298 of 2020 instituted for the offences under Sections 272, 273 and 120(B) of the Indian Penal Code read with Sections 30(a), 31(ii) and 41(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that 7606.125 litres country-made foreign liquor was seized as such the police had information from Excise Department that near Chaurasiya Chowk inside Arjun Memorial School co-accused Ravindra Kumar, Ram Lakhan Rai, Arjun, Sanjit and others were unloading the foreign liquor and as the

Learned counsel for the petitioner submits that the petitioner is in custody since 09.11.2020 and charge-sheet has been submitted in the case.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 09.11.2020 and charge-sheet has been submitted in the case, he is directed to be released on bail on furnishing of bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Bochaha P.S. Case No. 298 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C.
