JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-02-2016 Heard learned Counsel for the petitioners, learned Additional Public Prosecutor for the State and learned Counsel appearing on behalf of the informant. This application, for grant of anticipatory bail, arises out of Guraru Police Station Case No. 98 of 2015, disclosing offences under Sections 406, 420 and 504/34 of the Indian Penal Code.
The petitioners are said to be the Marketing Managers of Swabhumi Development Charitable Trust. They are said to have induced the informant and some others to deposit money in the said Trust on an assurance that they

The allegation is that the Managers of the said Charitable Trust have fled away and the petitioners and the Managers of the said Trust have thus misappropriated the amount deposited by the informant and other persons. Learned Counsel for the petitioners submits that even as per the allegation, the informant had deposited a sum of Rs. 7,200/- in the year 2012. He undertakes on the instructions given by the petitioners that a sum of Rs. 10,000/- will be paid to the informant within a period of two weeks from today.
Considering the above stand taken on behalf of the petitioners, this application is allowed. Let the petitioners, Lalan Nath Goswami and Ranjit Kumar @ Ranjit Gupta, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Rohit Kumar, Judicial Magistrate, 1st Class, Gaya, in connection with Guraru Police Station Case No. 98 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the

No.6049 of 2016 (2) dt.24-02-2016 3/3 petitioners shall present themselves before the police/Court, as the same may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
