====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 325, 376, 511/34 of the Indian Penal Code.

As per prosecution case, petitioner is alleged to have assaulted the informant by means of hasua and iron rod, causing injury on her hand.

Learned counsel appearing for the petitioner submits that petitioner is own brother of the husband of the informant. Injuries sustained by the injured are simple in nature and F.I.R. has been lodged after delay of 8 days without any plausible explanation.

Considering the delay in lodging the F.I.R. and simple

No.10873 of 2023(2) dt.15-05-2023 2/2 nature of injury, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Mahua P. S. Case No. 647 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
