====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 18-06-2025 Heard learned counsel for the petitioner and learned APP for the State as also learned counsel for the Informant. Perused the case diary.

2. The petitioner seeks bail in connection with Jalalpur P.S. Case No. 132 of 2024 instituted for the offences under Sections 302, 201/34 of the Indian Penal Code.

3. As per prosecution case, the Informant alleges that his son was murdered and his body was thrown into pond on the night of 08.05.2024, following a prior death threat by the coaccused Sanjay Rai.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case

Patna High Court CR. MISC. No.12777 of 2025(3) dt.18-06-2025 2/3 merely on the basis of suspicion. He further submits that there is delay of two days in lodging the F.I.R. that too without there being any plausible explanation for the same which creates doubt in the veracity of the prosecution case. The petitioner has not committed any offence as alleged in the F.I.R. He further submits that nothing incriminating has been recovered from the conscious/physical possession of the petitioner. Learned counsel for the petitioner submits that there is no direct or specific allegation of any overt act against the petitioner rather the same is general and omnibus in nature. The petitioner has no concern with the alleged offence and not a single witness has alleged anything adverse against the petitioner. The petitioner has no criminal antecedent and is languishing in judicial custody since 16.12.2024 without any rhymes or reason. Charge-sheet has been submitted in this case.

5. Learned counsel for the petitioner again submits that the co-accused namely Sanjay Rai @ Sanjay Ray has been granted bail by this Court vide order dated 14.05.2025 passed in Cr. Misc. No. 12890 of 2025.

6. On the other hand, learned A.P.P. for the State and the Informant have vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged against the

Patna High Court CR. MISC. No.12777 of 2025(3) dt.18-06-2025 3/3 petitioner is serious in nature. He further submits that the cause of death mentioned in the postmortem report is hemorrhage and shock due to sustained injuries.

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioner, there being no cogent material against the petitioner except suspicion and the chargesheet being submitted as also the petitioner having no criminal antecedent, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Jalalpur P.S. Case No. 132 of 2024.
