JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 20-06-2023 Heard learned counsel for the petitioners, informant and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 420, 447, 467, 468, 471, 485, 504, 506/34 of the Indian Penal Code. Petitioners are said to have participated in preparation of false and fabricated documents with their father. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case due to land dispute. He submits that there is specific allegation of cheating and conspiracy against the father of petitioners namely Rajpati Mandal. He submits that there is no

Patna High Court CR. MISC. No.10342 of 2023(3) dt.20-06-2023 2/2 direct or indirect evidence against the petitioners and no concern either with the alleged occurrence. He further submits that petitioners have no criminal antecedent as stated in para-3 of this application.

Learned APP for the State and learned counsel for the informant oppose the prayer for bail and submit that the petitioners have participated in creation of false document in order to get the wrongful.

Considering the facts and circumstances of the case and the nature of offence, I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for anticipatory bail is rejected in connection with Gopalpur (Rangra) P.S. Case No. 115 of 2022.
