20-06-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence under Section 302 of the Indian Penal Code.

3. Informant suspects that this petitioner committed the murder of her husband.

4. Learned counsel for the petitioner submits that informant is not eye-witness to the occurrence and only on suspicion petitioner has been made accused in this case. Petitioner is supervisor in Patna Municipal Corporation, whereas deceased was a daily-wage employee in the Corporation. As a matter of fact, on the alleged date of

No.17128 of 2024(5) dt.20-06-2024 2/2 occurrence, the deceased was in drunken condition and he fell down in the drainage, as a result of which, he sustained multiple injuries and died. He further submits that in this case, fardbeyan was recorded on 17.05.2023, but the case was instituted after lapse of three months on 23.08.2023 and there is no plausible explanation of delay. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Patna in connection with Gardanibagh P.S. Case No. 607 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
