The petitioner seeks bail in a case instituted for the offence under Section 398 of Indian Penal Code. It has been submitted on behalf of the petitioner that he is not named in the First Information Report. His name has transpired in the confessional statement of the co-accused. From the order of learned 5th Additional Sessions Judge, Darbhanga, it appears that his bail was cancelled merely on the ground that he was evading arrest for the last eight years and process under Section 82 and 83 of Cr.P.C. were issued against him. It has further been submitted that petitioner has no criminal antecedent and he is in custody since 05.12.2016.

No.4563 of 2017 (2) dt.15-02-2017 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 5th Additional Sessions Judge, Darbhanga, in connection with Sessions Trial No. 124 of 2011 ( arising out of Hayaghat P.S. Case No. 113 of 2008), subject to the condition that both the bailors will be the close relative of the petitioner.
