JUSTICE SANJAY PRIYA ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Ekchari P.S. Case No. 38 of 2016 instituted for the offence under Sections 25(1-b)a, 26 and 35 of the Arms Act.
It is alleged that one loaded Katta and three live cartridges were recovered from possession of the petitioner. The seizure list enclosed with the written report does not bear the signature of the petitioner. Petitioner is said to be in custody since 8.8.2016.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.12993 of 2017 (3) dt.18-04-2017 amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Ekchari P.S. Case No. 38 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
