On a police check, the petitioner alongwith Banti Kumar ran leaving behind a motorcycle which is said to be stolen one, but unfortunately they both have been apprehended. Further more, on inculpatory extra judicial confessional statement of Banti Kumar @ Laddu another motorcycle from the possession of Ujjawal Kumar has been recovered. It has further been disclosed that the aforesaid Banti Kumar named Gulshan Kumar as leader of the gang.

Learned counsel for the petitioner submits that in worse case it happens to be a case of joint possession and for that, the petitioner, who has got no criminal antecedent, is under custody since 29.12.2019.

Patna High Court CR. MISC. No.9666 of 2020(2) dt.06-03-2020 2/2 Learned A.P.P. opposed the same.

Accordingly, the petitioner, Rohit Kumar, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Bodh Gaya P.S.Case No. 547/2019.
