JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code, Sections 25(1-B)a, 26, 35 of the Arms Act and Section 3⁄4 of Explosive Substance Act.
The petitioner was caught with others while assembled to make preparation for committing dacoity and one katta along with one bomb are said to have been recovered from his conscious possession.
It would appear from para-2 of the petition that earlier his prayer for bail was rejected by this court but submission on behalf of the petitioner is that petitioner is in jail custody since
Patna High Court Cr.Misc. No.13704 of 2017 (3) dt.26-04-2017 2/2 26.02.2016 but up till now even charge could not be framed against him.
Therefore, considering the period of detention of the petitioner in jail custody as well as facts and circumstances of the case, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 34 of 2016. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
