The petitioner seeks bail in Nokha P.S. Case No. 46 of 2017 registered under Sections 272, 273 and 120B of the Indian Penal Code and Section 30 of the Bihar Prohibition and Excise Act, 2016.

The police intercepted a motorcycle and a Magic vehicle. The driver of the Magic vehicle managed to flee away. But Pramod Kumar and Tinku Kumar who were riding on the motorcycle were apprehended and disclosed that they have unloaded some quantity of liquor at the house of Umashankar Singh @ Lal Babu in the village Gaurishankar Tola and the remaining was to be unloaded at the house of Prince Kumar @

Leanred counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. Considering the facts aforesaid and that the name of the petitioner figured in the disclosure made by Pramod Kumar and Tinku Kumar, but nothing has been recovered from the possession of the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nokha P.S. Case No. 46 of 2017.
