Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 324, 504, 506, 448, 380, 384, 379, 307 and 34 of the Indian Penal Code, registered in connection with Ishakchak P.S.Case No. 60 of 2020. The learned counsel for the petitioners has submitted that there is no allegation against the petitioners to assault the members of the informant's side. The only allegation against them is that they had caught hold of the goat of the informant and demanded Rs. 500/- from him. He has submitted further that the petitioners are the persons of clean antecedent and co-accused persons, namely, Md. Javed @ Shahnawaz @

Patna High Court CR. MISC. No.11645 of 2022(2) dt.21-09-2022 2/2 Shanawaz, Md. Raja @ Zulfikar @ Md. Zulfikar Rizvi and Md. Zeshan Rizwi, against whom there is allegation of assault, have been granted anticipatory bail by a coordinate Bench of this Court in Cr.Misc. No. 7692 of 2021 and the case of the petitioners is on better footing.

Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak P.S.Case No. 60 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
