JUSTICE SUDHIR SINGH ORAL ORDER 04-03-2020 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners seek bail in a case registered under Sections 341, 323, 324, 325, 307/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons including the petitioners assaulted the informant and his father by bhala and fire arm, due to which they sustained injuries. It has been submitted on behalf of the petitioners that the petitioners are in custody since 08.11.2019 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged

Patna High Court CR. MISC. No.9125 of 2020(2) dt.04-03-2020 2/2 against the petitioners. The petitioner No.1 is alleged to have given a single bhala blow and petitioner No.2 is said to have given a single fire shot causing injury on non-vital part of the body. There is no repetition made on the part of the petitioners. The petitioners had no intention to commit murder. Hence, no offence under Section 307 of the I.P.C. is made out. It is further submitted that the petitioners may be released on bail after completion of six months in custody from 08.11.2019. On behalf of the State and learned counsel for the informant, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail after completion of six months in custody from 08.11.2019 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Imadpur P.S. case No.84 of 2019.
