Petitioners apprehend their arrest in connection with Sarairanjan P. S. case no. 341/2013 registered under sections 323, 324, 307 and other allied sections of the Indian Penal Code. There is allegation against these petitioners that they gave farsa blow on the head of the injured- Poonam Devi. The injuredPoonam Devi has sustained, altogether, four injuries on her head which is vital part of the body but all the four injuries were found simple in nature said to be caused by hard and blunt substance. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition stands rejected with direction to petitioners to surrender in connection with Sarairanjan P. S. case no. 341/2013 before Sri Ravindra Kumar,
Patna High Court Cr.Misc. No.11032 of 2015 (3) dt.05-05-2015 Judicial Magistrate, Ist Class, Samastipur/concerned court within four weeks from today and seek regular bail and if they do so, the concerned court shall consider regular bail petition of the petitioners on the day of their surrender on its own merit without being prejudiced by this rejection order, particularly, keeping in mind that the injured- Poonam Devi has sustained simple injuries said to be caused by hard and blunt substance and alleged occurrence is said to have taken place on account of land dispute.
