JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 29-04-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-B) a, 26, 35 of the Arms Act.
The prosecution case as per F.I.R is that on receiving information that miscreants are planning to commit loot, raid was laid and two persons were apprehended and from their possession, one country
Patna High Court CR. MISC. No.15942 of 2023(2) dt.29-04-2023 2/3 made pistol, two live cartridges and one motorcycle was recovered.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R and his name transpired subsequently on the confessional statement of coaccused Chandan Kumar @ Bhola and Veeru Paswan. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has not been put on T.I.P. The petitioner is languishing in custody since 29.10.2022. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief
