2. The same is allowed.

3. However, if the petitioner surrenders before the learned Court below for grant of regular bail within a period of three weeks from today, the same shall be considered on its own merit without being prejudiced by the present withdrawal order and the learned Court below would also take into consideration the fact that the similarly situated co-accused person Gautam Kumar, who is the son of the present petitioner, has also been granted the privilege of regular bail by a Co-ordinate Bench of this Court.
