Petitioners are seeking anticipatory bail in connection with Rajapakar P.S. Case No. 196 of 2018 registered for the offences punishable under Sections 341, 324, 379, 504, 354/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that as per allegations in the First Information Report, petitioner no.1 had allegedly given a 'Garasa' blow which had caused injury on the finger of the left hand of the informant. It is alleged that petitioner no.2 had caught hold of wife of the informant and had made her nude and took away the Gold earrings and box kept in

Submission is that the informant and the petitioners are close agnates. They are co-sharers and are fighting over a land in connection with which both the parties seems to have indulged in some fight but the allegation is that these petitioners had indulged in giving 'Garasa' blow overhead and made nude the wife of the informant are not correct, flimsy allegations have been made just to harass these petitioners.
Learned APP for the State is present and has opposed the prayer for bail.
Considering the facts and circumstances of the case, wherein both the parties are said to be the co-sharers and are fighting over a land dispute and no specific injury has been brought to the notice of this Court, considering the nature of the allegations, this Court is willing to grant the privilege of anticipatory bail to the petitioners. Let in case of their arrest or surrender within a period of four weeks from today, the abovenamed petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M, Vaishali in connection with Rajapakar P.S. Case No. 196 of 2018, subject to the condition that petitioners
