====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Bhagwan Bazar P. S. Case No. 23/2023 in a case registered for the offences punishable under Section 414 of the Indian Penal Code, Sections 25(1-b)a, 26, 35 of Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 80 liters illicit liquor along with arms and ammunition was recovered from five motorcycles. Petitioner is alleged to have fled away from the place of occurrence.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious

Petitioner is neither driver nor owner of the motorcycles in question. He has been made accused in this case merely on the basis of confessional statement of co-accused. Petitioner is in custody since 04.01.2025.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge 2nd cum 1st Exclusive Special Judge, Excise, Saran at Chapra in connection with Bhagwan Bazar P. S. Case No. 23/2023.
