In this case, the rice of the petitioner was seized under the E.C. Act, but in criminal case the petitioner has been acquitted, whereafter, the petitioner demanded for return of the price of the rice, which was auction sold, has been allowed by this Court, but the District Magistrate, Madhubani, has taken stand that the price of the rice has already been returned to the petitioner, which the petitioner denies.

The issue involved in this case cannot be adjudicated in the present proceeding, it can be only adjudicated in a proper

Patna High Court CWJC No.3666 of 2015 dt.25-01-2017 2/2 Civil Court. Hence, the petitioner is directed to take legal action in accordance with law.

With the aforesaid observations and directions, this writ application is disposed.
