The petitioners seek bail in Paroo P.S. Case 12 of 2017, G.R. No. 97 of 2017 instituted for the offence under Sections 147, 148, 149, 341, 342, 323, 324, 325, 326, 506, 307, 353, 332 and 333 of the Indian Penal Code.

From the Fard-beyan, it appears that the police party went for verification of name and address of accused Ajay Rai in connection with Kuchaikot P.S. Case No. 04 of 2017 and as soon as the police reached Thegpur village, from the Bathan of Ajay Rai, petitioners and other accused persons came and surrounded the police party. There is allegation against the petitioner No. 1 that he caused injury with Garasa on the head of Chowkidar

Patna High Court Cr.Misc. No.19093 of 2017 (2) dt.02-05-2017 2/2 Krishna Yadav. There is no any allegation of specific assault against petitioner No. 2.

It has been submitted that other accused persons namely, Kamlesh Rai and Naresh Rai with similar allegation have already been granted bail by a coordinate Bench of this Court vide order dated 12.4.2017 passed in Cr. Misc. 17963 of 2017.

In the order of learned Sessions Judge there is no mention of any injury on the person of the injured. In such circumstances, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Aditya Kumar Singh, Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Paroo P.S. Case No. 12 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioners.
