The petitioner seeks regular bail in connection with Complaint Case No.2349 of 2014 registered for offences punishable under Sections 498A & 406/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner is ready to keep the informant and he is also ready for one time settlement in this case.

Heard learned A.P.P. and the learned counsel for the informant.

The informant is not ready for one time settlement rather it

Patna High Court Cr.Misc. No.16509 of 2017 (7) dt.19-05-2017 2/2 is stated that the O.P.No.2 is still ready to reside with the petitioner.

Having heard both sides and in view of the facts and circumstances, as stated above, and the petitioner is in custody for about three months and he is ready for final settlement, as such, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Siwan in connection with Complaint Case No.2349 of 2014. With following conditions :

(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.

(iv) It is also made clear that even during the trial, if the parties are ready for settlement, it is open to the court to consider the same and pass appropriate order. With the aforesaid observation, this application is allowed. (Vinod Kumar Sinha, J) chn/- U
