1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Excise Act.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is in custody since 29.01.2025 and allegation is of recovery of 100 litres of liquor from a place near a wheat field.

4. The learned counsel for the petitioner submits that petitioner was not arrested from the spot, as such, nothing was recovered from his conscious possession. It is further submitted that petitioner had earlier moved this Court seeking anticipatory bail by filing Cr. Misc. No.43214 of 2024 and the same was allowed by an order 08.07.2024. It is next submitted that

Patna High Court CR. MISC. No.11625 of 2025(2) dt.05-03-2025 2/2 petitioner could not surrender within the time stipulated in the order dated 08.07.2024, as such, his bail bonds were not accepted. It is next submitted that petitioner surrendered on 29.01.2025.

5. Learned A.P.P. opposes the bail application.

6. Considering the submissions made by the learned counsel appearing on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise-II, Saran, Chapra in connection with Sonepur P. S. Case No.251 of 2024.

7. The application stands allowed.
