JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 367, 370, 371, 120B of the Indian Penal Code and Section 3(2)(v) of the SC & ST (Prevention of Atrocities) Act.

The prosecution case is that on 15.10.2015 at 4:30 P.M the informant went to the grocery shop when Binod Singh, Mukesh Singh, Suresh Singh and Sunil Singh caught hold the informant and took him to their house and confined him where two men and one women were confined from before. The informant subsequently came to know that this petitioner sold all the confined people to one Suresh Singh. When the family members of the informant came to know about the confinement of the informant, they informed to the police and thereafter the informant and others were released from the captivity of the accused persons.

Patna High Court Cr.Misc. No.7329 of 2016 (2) dt.18-02-2016 2/2 It is submitted by learned counsel for the petitioner that the accusation of confinement is not against the petitioner. The informant never seen the petitioner at the place of the occurrence and in 164 Cr.P.C statement also the confined persons including the petitioner did not name the petitioner.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Nawada in connection with Nardiganj P.S. Case No. 137 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
