This is an application for bail in connection with Saraiya P.S.Case No. 298 of 2015, G.R.No. 2163 of 2015, registered for the offences punishable under Section 304B/34 of the Indian Penal Code.

Petitioner is the husband of the deceased and the case is under Section 304B IPC. Allegation against the petitioner and other co-accused is of demand of dowry and torture and also allegation is that deceased was killed prior to the lodging of FIR and dead body was found in badly decomposed condition from the house of the petitioner.

It has been submitted on behalf of the petitioner that petitioner was not present at the place of occurrence at that time

Patna High Court Cr.Misc. No.17136 of 2017 (2) dt.13-04-2017 2/2 and he has falsely been implicated in this case. Heard learned APP also.

Having heard both sides and considering the nature of allegation and petitioner is husband of the deceased, I am not inclined to grant bail to the petitioner.

However, learned trial court is directed to expedite the trial.

This application is, accordingly, dismissed.
