Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners apprehend their arrest in connection with Complaint Case No. 113C of 2009, registered for the offences punishable under Sections 498 A and 385 of the Indian Penal Code. At the outset, learned counsel for the petitioners has submitted that it is a matrimonial dispute and petitioners are mother-inlaw and devar of the complainant. He has also submitted that as per

Patna High Court CR. MISC. No.22217 of 2021(3) dt.23-02-2022 2/2 order of Principal Judge Family Court, the complainant is getting maintenance of Rs. 17,000/- per month from her husband. The husband of the complainant has already been granted bail vide B.P. No. 879 of 2020. It has further been submitted that the petitioners are living separately having no concern with day to day affairs of the couple. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Danapur in connection with Complaint Case No. 113C of 2009, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
