The petitioner is languishing in custody for the offences punishable under Sections 341, 323, 498(A), 328, 304(B)/34 of the Indian Penal Code in connection with Rahui (Wena) P.S. Case No. 208 of 2018.
Petitioner is husband of the victim of the dowry death. Wife of the petitioner died within 15 months of her marriage in unnatural circumstances in her matrimonial house. Allegation is of demand of dowry and torture for the same soon before death. Submission of learned counsel for the petitioner is that informant has filed a petition before the Court below that at
Patna High Court CR. MISC. No.13518 of 2019(3) dt.11-04-2019 2/2 the time of lodging of FIR, his mental condition was not normal, in fact the daughter of the informant was ill and the accused persons were carrying her for medical aid and on the way she died.
Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Hence, his prayer for bail is refused.
However, the trial Court is directed to expedite the trial considering the petition of the informant on the record and conclude the same preferably within 6 months, if the prosecution is fully co-operative, without granting any unnecessary adjournment in the case.
