The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.
As per the prosecution case, petitioner inflicted repeated Tangi blow on the head of the informant, as a result of which, the informant received multiple injury. It is submitted on behalf of petitioner that F.I.R. has been lodged after delay of seven days. There is case and counter case. Petitioner has got clean antecedent.
However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner is named in the F.I.R. and there is specific allegation against him of causing repeated Tangi blow on the head of informant, as a result of which, informant
Patna High Court CR. MISC. No.11329 of 2022(2) dt.08-08-2022 2/2 received three injuries, out of which, two injuries are grievous in nature.
Considering the aforesaid facts and circumstances, I am not inclined to extend the privilege of anticipatory bail to the petitioner and same is, accordingly, rejected. (Prabhat Kumar Singh, J) anay/- U T
