JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-01-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Chapra (M) P.S.Case No. 296 of 2020 registered for the offences punishable under Sections 467, 468, 471, 420, 120B of the Indian Penal Code and section 30(a), 36,38,41 and 47 of the Bihar Prohibition and Excise Act.

Allegation against the petitioner is that 14.6 liters country made liquor was recovered from the Motorcycle bearing Registration No. BRO4AD-8266 and the motorcycle in question belongs to the petitioner. Neither petitioner was arrested on the spot nor anything has been recovered from his conscious possession.

Learned APP for the State has opposed the prayer for

Patna High Court CR. MISC. No.21830 of 2021(2) dt.03-01-2022 2/2 anticipatory bail of the petitioner.

Considering the alleged liquor was recovered from his motorcycle, I am not inclined to grant anticipatory bail to the petitioner in connection with Chapra Muffasil P.S.Case No. 296 of 2020, pending in the court of Special Judge, Excise, Saran at Chapra stands rejected.
