The petitioners seek bail in Sabour (Goradih) P.S. Case No. 16 of 2022, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

195 litres of foreign liquor has been recovered from Alto Car of which petitioner no. 1 was driver and petitioner no. 2 was owner.

It is submitted that no recovery has been made from conscious possession of petitioners. Petitioners are in custody since 12.01.2022 having no criminal antecedent, as stated in

Patna High Court CR. MISC. No.11750 of 2022(2) dt.29-04-2022 2/2 para 3 of the petition. Investigation is complete. Considering the period of custody coupled with the fact that petitioners bear clean antecedent, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Exclusive Excise Court No. 2, Bhagalpur in connection with Sabour (Goradih) P.S.
