JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 34 of the Indian Penal Code.
The prosecution case is that the petitioner realized Rs. 90,000/- from the informant for providing employment in Japan.
It is submitted by learned counsel for the petitioner that there is nothing on record to prove with regard to the payment to the petitioner and the informant and his family members lodged three cases with similar accusation against the petitioner being Andar P.S. Case No. 156, 157 and 158 of 2014. The whole exercise is to grab the land of the petitioner.
Considering the nature of accusation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today,
Patna High Court Cr.Misc. No.7308 of 2016 (2) dt.18-02-2016 2/2 be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Andar P.S. Case No. 156 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
