Learned counsel for the petitioners are expected to honour their undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioners are apprehending their arrest in connection with Bihjpur (Jhandapur) P.S. Case No. 272 of 2020 for the offence registered under Sections 341, 323, 325, 307, 379, 504 and 506/34 of the Indian Penal Code. Allegation, as alleged against the petitioners is that they assaulted the informant and his son.
Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.21230 of 2021(2) dt.20-12-2021 2/2 petitioners have falsely been implicated in connection with the present case. It is further submitted that two persons are injured in this case and the injury sustained by them is simple in nature as it appears from Injury report (Annexure-2) to the bail petition. It is further submitted that the petitioners have no criminal antecedent.
Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM -1st Naugachia, Bhagalpur in connection with Bihpur (Jhandpur) P.S. Case No. 272 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
