The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, about 8442 litres of liquor was recovered from the Government agricultural farm at village Kairella.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. His name transpired in the confessional statement of co-accused Raj Kumar Yadav made before police. No incriminating article has been recovered from his possession. The petitioner is in custody since 4.1.2021,

Patna High Court CR. MISC. No.20612 of 2021(2) dt.07-09-2021 2/2 has no criminal antecedent and investigation in the case has concluded. It is lastly submitted that the co-accused Raj Kumar Yadav has been enlarged on bail vide order passed in Cr. Misc. No. 82845 of 2019.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Excise Case no. 331 of 2020 (arising out of Chand P.S. Case no. 186 of 2019) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II - cum - Special Judge, Excise, Kaimur at Bhabua. (Partha Sarthy, J) Spd/- U T
