The case is registered under section 302/34 of the Indian Penal Code and 27 of the Arms Act in connection with Mufassil P.S. Case no. 163 of 2019.

The specific allegation against him is that he opened fire on right side of the head of the victim/ brother of the informant Gulshan Kumar which resulted into his death. Earlier the petition was taken up in Cr. Misc. No.59921 of 2021 and rejected on 18.04.2022.

There is direct allegation against the petitioner and in that backdrop this Court is not inclined to extend him privilege of bail which is accordingly rejected.

However, taking into account the period of custody,

Patna High Court CR. MISC. No.15069 of 2023(2) dt.22-03-2023 2/2 the learned Trial court is directed to expedite the matter and conclude the same preferably within a period of nine months, failing which a report be submitted for the delay. With the aforesaid observation, petition stands dismissed.
