JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 03-11-2021 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Mr. Akhileshwar Dayal, learned A.P.P. for the State. Petitioner in the present case is seeking regular bail in connection with Teghra P.S. Case No. 235 of 2020 registered for the offence punishable under Section 414, 120(b) of the Indian Penal Code and Section 309a)/40(1)(2) of the Bihar Prohibition and Excise Act, 2016. He is in custody since 23.12.2020. Petitioner has got seven criminal antecedents. Learned counsel for the petitioner submits that the informant who is the S.I. of Police on the basis of the secret information intercepted one Bolero vehicle and one Pulsar
Patna High Court CR. MISC. No.20996 of 2021(3) dt.03-11-2021 2/3 motorcycle. It is alleged that one person from the Bolero vehicle and two persons riding on Pulsar motorcycle started fleeing away and on chase two persons were apprehended. The informant recovered altogether 326 litres of foreign liquor from the Bolero vehicle and the motorcycle. It is alleged that the apprehended persons stated that the liquors belongs to the petitioner and others.
Mr. Akhileshwar Dayal, learned A.P.P. for the State has opposed the prayer for regular bail of the petitioner. It is submitted that the petitioner has got four criminal antecedents out of total seven cases against him of similar nature and this case is the fifth case in a row.
Having regard to the facts and circumstances of the case wherein it has come in course of investigation that the illicit liquors which were seized were the part of the consignment which belongs to this petitioner and his group, the petitioner has got four criminal antecedents out of total seven cases against him of similar nature, this case is the fifth case in a row, this Court is not inclined to enlarge the petitioner on bail at this stage.
Let the trial be expedited.

Patna High Court CR. MISC. No.20996 of 2021(3) dt.03-11-2021 3/3 court and all endeavour be made to conclude the trial as early as possible preferably within a period of six months from the date of communication of this order. The prosecution must cooperate by bringing all the witnesses on the date fixed in the matter.
If the trial still remains unconcluded for no reason attributable to the petitioner, he may renew his prayer for bail.
