ANJANA MISHRA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Darbhanga Town P.S. Case No.74 of 2014 for allegedly having committed the offence under Sections 324, 307 and 120B of the Indian Penal Code.

It is submitted on behalf of the petitioner that there was a love affairs between the sister of the petitioner, namely, Neetu, with the brother of the informant, namely, Mahesh Kumar Mahto. It is further submitted that only on account of the fact that the informant had protested and resisted the said marriage, that the victim boy out of frustration himself cut his neck with sharp cutting weapon. It is submitted that now both

Patna High Court Cr.Misc. No.5523 of 2016 (3) dt.13-05-2016 2/2 the parties have amicably resolved the dispute and they have filed an application in the court of the Chief Judicial Magistrate, Darbhanga to the effect that they do not want to pursue the matter.

In view of the aforementioned facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Darbhanga, in connection with Darbhanga Town P.S. Case No.74 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
