The petitioners apprehend their arrest in Bidupur P.S. Case No. 269/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The informant alleged that the petitioners and others in order to grab the land brutally assaulted her and other female members of her house.
Learned counsel for petitioners submits that there is counter version bearing Bidupur P.S. Case No. 268/2016. The informant and others are accused in the case. The informant also sustained injuries. The present case is later in point of time. On account of land dispute this false case has been lodged, but from
Patna High Court Cr.Misc. No.10443 of 2017 (3) dt.11-04-2017 2/2 the injury report, it appears that the informant along with all other female members namely, Sarita Devi, Chinta Devi and Bhagwati Devi got simple injuries.
Considering the facts aforesaid and the fact that the petitioners have assaulted the informant along with other female members of the house of the informant, I am not inclined to enlarge the petitioners above-named on anticipatory bail. Accordingly, the same is rejected.
