JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-03-2019 The petitioner seeks bail in anticipation of his arrest in connection with Khajekalan P.S. Case No. 205 of 2015, dated 15.09.2015, instituted for the offences under Sections 341, 323, 324, 379, 504 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Though the petitioner has been named in the F.I.R., but the allegation of firing from their respective weapons have been attributed to other accused persons.
Patna High Court CR. MISC. No.13660 of 2019(2) dt.08-03-2019 2/2 It has been submitted on behalf of the petitioner that even the injury report of the informant is not on record. The cause of occurrence is stated to be some dispute between the students in a coaching centre.
Regard being had to the nature of accusation against the petitioner and taking into account his clean antecedents, he, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Patna City, Patna in connection with Khajekalan P.S. Case No. 205 of 2015, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
