By order dated 04.07.2017 the petitioner was directed to be released on provision bail and opposite party no.2 was noticed but in spite of receipt of notice by her father the opposite party no.2 has not appeared to oppose the prayer of bail of the petitioner.

It has been submitted on behalf of petitioner that the petitioner has not tortured the opposite party no.2 in any way and he is always ready to keep his wife (O.P. no.2) with full dignity. The petitioner was in custody since 15.02.2017 thereafter he was directed to be released on provision bail by order dated 04.07.2017. It is further submitted that the opposite

No.15722 of 2017(3) dt.04-04-2018 2/2 party no.2 has married with another boy namely Munna Yadav on 13.03.2015 in a temple and the mukhiya of said panchayat has granted certificate to this effect vide Annexure-3. The learned A.P.P. submitted that it is a case under Section 498A and 494 of the I.P.C.

Under the facts and circumstances as stated above, the provisional bail granted to the petitioner vide order dated 04.07.2017 is hereby confirmed.
