JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-09-2019 This application, for grant of anticipatory bail, arises out of Ariyari P.S. Case No. 128 of 2018, disclosing offences under Sections 498A/34 of the Indian Penal Code. Petitioner happens to be husband of the informant and allegation against the petitioner is of demand of Rs. One Lakh as dowry for starting a business and on non fulfilment of the said, demand he assaulted and tortured the informant. It appears that on appearance of opposite party no. 2, the matter was referred to Patna High Court Mediation and Conciliation Center, Patna and the report of learned Mediator is available on record, from which, it appears that in spite of two dates fixed, the petitioner did not appear and due to that mediation between the parties failed.

Heard learned A.P.P. also as well as learned counsel for the informant. Learned counsel for the informant has also submitted that informant is also ready for one time settlement. In such view of the matter, this application is disposed of with direction to the petitioner to appear in the court below on 26.09.2019 and on that date opposite party no. 2 informant shall also appear before the court below, on which, the court below shall extend the provisional bail of the petitioner for further period of three months and refer the matter to District Mediation Center, who will make effort for agreeable settlement between the parties and the court below after receiving the mediation report as well as after satisfying himself with the conduct of the parties, may consider for affirmation of provisional bail of the petitioner otherwise, he would be free to pass any order/order as he deems fit and proper.
